about the aguinaldo

Hello dear reader! In this new edition, we want to talk about the bonus that you should perceive your co-workers, how to calculate it, and the obligations of both parties with this provision.

What is the aguinaldo?

  • The christmas bonus is a compulsory payment that they have to give the employers to their employees in December (that’s why it is known as the aguinaldo christmas or decembrino), established in article 87 of the Federal Labour Act, 1970, being a payment independent of the bi-weekly payments or monthly made during the year.

What says the Federal Labor Law in Mexico?

According to the mexican labor law, employers must pay the christmas bonus christmas before December 20 of each year. It is also common practice that an agreement is reached with the co-workers to split the payment into two: one referred to in the defined date according to the law, and the other at the beginning of the year. This is so that they have sufficient income in January to return to the work activity.

This compensation is a right of all employees that work within the country and are paid a wage. For employees who have spent more than a year working in a company, it is up to 15 days of salary. In case of not having this age, you should learn how to calculate the year-end bonus proportional.

To do this, you need to look at how much you earn a collaborator by half and divide it by 365 days of the year. Then, multiply by the number of days worked of the employee.
